1. Heard learned counsel for the petitioner and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Sabarang P.S. Case No.184 of 2025 corresponding to G.R. Case No.1812 of 2025 pending in the court of learned S.D.J.M., Bhadrak on the grounds stated.
3. State has produced the case diary and statements of the witnesses recorded under Section 180 BNSS and also the medical examination report of the victim for the Court’s perusal as was directed earlier by order dated 27th November,
2025. Learned counsel for the petitioner submits that the alleged incident has taken place when the informant objected the petitioner in selling liquor. It has been alleged in the FIR at Annexure-1 that the petitioner assaulted the informant by means of a ‘Bhujali’. But, from the examination report dated 29th September, 2025, the Court finds that there is a single
simple injury with the opinion that it might have been caused by a sharp object. Considering the above facts and recording the submission of learned counsel for the petitioner that the present accused is having no other criminal antecedent and objection of the State, this Court is of the view that he should be directed to surrender before the learned court below for being released on bail even, though, it is not inclined to grant him pre-arrest bail as pleaded at present.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before learned S.D.J.M., Bhadrak in connection with Sabarang P.S. Case No.184 of 2025 corresponding to G.R. Case No.1812 of 2025, he shall be released on bail upon furnishing a bail bond of Rs.30,000/- (rupees thirty thousand) with one solvent surety for the like amount with further conditions, such as, he shall not cause any harm or injury to the informant after being released and to co- operate the IO in the investigation as and when necessary.
6. Issue urgent certified copy of this order as per rules.
