2. I.A.No.3 of 2024 has been filed by the respondent/husband seeking visitation rights to meet his minor son.
3. The petitioner/wife had challenged the application stating that the respondent/husband had threatened to kill the child.
4. The learned Family Judge, Salem after considering the
arguments of both parties has held that the child requires the love and affection of both parents even if they are separated. Ultimately, taking into account the interest of the minor the learned Judge had allowed the application. Challenging the same the petitioner/wife is before this Court.
5. Heard the counsel for the petitioner and perused the records.
6. The only ground that has been raised is a stray statement 2/4 https://www.mhc.tn.gov.in/judis
CRP(PD).No.614 of 2025 made by the petitioner/wife that the respondent/husband would kill the child. The fact that the respondent/husband has taken out an application seeking visitation rights would only go to show that he wants to establish a tie with his child as a father. He is also entitled to give his love and affection to the child. The allegation that the respondent/husband had threatened to kill the child remains an allegation only as there is nothing to substantiate the same. Therefore, the order passed by the learned Family Judge, Salem is very much in
order and I see no reason to interfere with the same.
