Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toIssue an appropriate writ, order or direction, more particularly one in the nature of writ of Mandamus declaring the action of the respondents in asking the petitioner to participate in the selection process once again for appointment of Mentors by email letter dt.
18.5.2011 and sought to replace the petitioners who were selected as Mentors on contract basis in regular process of selection as illegal, un-just, arbitrary, thereby violative of Article 14, 16 and 21 of the Constitution of India and consequently direct the respondents herein to continue the petitioners in service as Mentors duly regularizing their service and pass Counsel for the Petitioner(S):

ORDER:
The Writ Petition is filed under Article 226 of Constitution of India for the following relief/s
“…to issue an appropriate writ, order or direction, more particularly one in the nature of writ of Mandamus declaring the action of the respondents in asking the petitioner to participate in the selection process once again for appointment of Mentors by email letter dt.18.05.2011 and sought to replace the petitioners who were selected as Mentors on contract basis in regular process of selection as illegal, un-just, arbitrary, thereby violative of Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondents herein to continue the petitioners in service as Mentors duly regularizing their service and pass such other
order or orders…..”

The grievance of the petitioners in the Writ Petition is that the petitioners were appointed as Mentors on contract basis after due selection process on 25.09.2009, the petitioners were called on to participate in entire selection process once again for the academic year 2011 and 2012 with an intention to appoint their own candidates by replacing the present incumbents and it is further case of the petitioners that the respondents have conducted general aptitude test in the year 2009 while weeding

out the unsuccessful candidates in the interviews, the petitioners were selected in the general aptitude test, were asked to attend pre-assessment test in the concerned subject earlier for the posts of Mentors. The petitioners were subjected to training for a period of two months. During the training period, they have conducted weekly test in the subject of information technology, general English and the concerned subject. After completion of the training period, the petitioners were subjected to final assessment test in the concerned subject. And the present Writ Petition is filed seeking a direction to the respondents to continue the petitioners’ service duly regularizing their services.
3. This Court vide order dated 05.07.2011 granted interim direction directing the respondents herein to continue the petitioners. No counter is filed.

Learned counsel for the petitioner placed the order dated 01.04.2025 in W.P. No.47802 of 2018 and requested this Court to pass similar orders and the counsel for respondents have not objected for the same.
5. After perceiving the order in W.P. No.47802 of 2018 warily, this court noticed that the said Writ Petition was disposed of directing the respondents No.1 and 2 to consider and to pass

appropriate order on the recommendation of the Universities i.e. Respondent Nos.3 to 5, in the light of the judgments of the Hon’ble Apex Court in State of Karnataka Vs. Umadevi, Nihal Singh Vs. State of Punjab, and Jaggo Vs. Union of India and others stipulating three months time.

Learned counsel appearing for the petitioners placed G.O.Ms.No.30, Higher Education (EC) Department, dated 31.08.2020 and stated that the government of Andhra Pradesh has sanctioned 420 Teaching and 178 Non- teaching posts to the Institutions of RGUKT, [i.e. 210 teaching posts and 89 non-teaching posts to each campus] for efficient and effective functioning of RGUKT Campuses, and urged to this Court to direct the respondents to regularise the petitioners considering the judgments referred supra.
7. Learned Government Pleader for Higher Education contended that the petitioners were appointed on temporary basis. Therefore, they have no right to seek for regularization as a matter of right and there are no merits in the Writ Petition. Hence, prayed to dismiss the Writ Petition.
8. It is undisputed fact that the petitioners appointed in the year 2009 and their appointment has been made after due

procedure and since then they are discharging their duties as Mentors.

Therefore, the present Writ Petition is disposed of directing the respondents to consider the recommendations of the University in the light of the Judgments referred supra, in accordance with law within a period of three months from the date of receipt of the copy of the order. However, there shall be no
order as to costs.
