Considering the stand being taken by the petitioner, the learned Advocate for the petitioner submits that the petitioner is ready to approach the Collector u/s 24 of the Maharashtra Highways Act, 1955, however, he may be extended some breathing time in as much as the acts would fall any moment in the form of removal of the alleged encroachment pursuant to the notice in question Exh.B, dated khs/Feb.2025/2616 2025:BHC-AUG:5710 - 2 - 31.01.2025. 3. We dispose of the petition with liberty to the petitioner to resort to the aforementioned remedy within 2 (two) weeks.
