The petitioner has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind bars since 19.03.2025 in connection with GR Case No. 217/2025 arising out of Sipajhar Police Station Case No. Page No.# 2/2 46/2025 under Section 303(2) of the BNS. 3. Heard Mr. D. P. Goswami, learned Additional Public Prosecutor, Assam. 4. The allegation against the petitioner is that he has committed theft of a scooter and cash of Rs. 8000/- from the ATM card of the informant. 5. I have considered the submission that the petitioner is behind bars since 19.03.2025. I have considered the submission that the scooter has already been recovered. The petitioner is willing to cooperate with the remaining part of investigation. 6. Considering all aspects, petition is allowed. The petitioner shall be enlarged on bail on furnishing a bail bond of Rs. 30,000/- with a suitable surety of like amount to the satisfaction of the learned SDJM, Mangaldoi under the conditions that: (i) The petitioner shall refrain from such activities with which he is alleged, and (ii) The petitioner shall appear before the Investigating Officer on every fortnight till completion of investigation. On breach of any of the bail conditions, the learned Court is at liberty to immediately cancel the bail granted to the petitioner. 7.
