The petitioner has approached this Court with a complaint that his wife Ms. K. Naga Lavanya is being illegally detained by her parents, who are arrayed as respondents No.4 and 5 herein. The petitioner seeks a Writ of
Habeas Corpus for release of his wife from the custody of respondents No.4 and 5. 2. The alleged detenu has been produced before us by the respondent No.3. 3. We have interacted with her in our Chambers. Upon being asked, the alleged detenu, Ms.K. Naga Lavanya, states that she wishes to go with the petitioner and wants to lead a married life with the petitioner. 4. We have also interacted with the respondents No.4 and 5. They have stated that they are unhappy with the said situation but would not come in the way, if the alleged detenu wishes to live with the petitioner. They have also stated that they would have nothing further to do with the alleged detenu, if she so chooses to go away with the petitioner. 5. Though both the petitioner and the alleged detenu claim that they are married, it appears that the marriage ceremony, which they have gone through, was a Christian Marriage ceremony, even though the alleged detenu remains a Hindu. 6. In view of the doubtful legality of such marriage, the petitioner and the alleged detenu state that they would get married under the Special Marriage Act. So that, there is no doubt about the legality of their marriage. 7. In view of clear cut statement of the alleged detenu that she wishes to live with the petitioner, this Court is inclined to dispose of the writ petition. 8. Accordingly, the Writ Petition is disposed of with a direction to the respondent No.3 to safely escort the alleged detenu to the house of the petitioner. No costs.
