This Application has been filed by the applicant seeking anticipatory bail in Case Crime No.331 of 2025, registered at Police Station Kashipur, District Udham Singh Nagar under Sections 109, 117(2), 126(2), 190, 191(2), 191(3), 3(5), 324(4), 351(2), 352 of the Bharatiya Nyaya Sanhita, 2023 and Section 3 (1)(r) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. 2. According to the First Information Report dated 31.07.2025, the informant was confined by the applicant and others on the way at around 9:00 a.m. to 9:30 a.m. on 30.07.2025. They beat the informant. Applicant and others verbally abused Sumit using 1 2025:UHC:7391 caste-based slurs, who had come on the spot to save the informant. 3. Heard Mr. Tapan Singh, learned counsel for the applicant and Mr. Tumul Nainwal, learned Assistant Government Advocate for the respondent. 4. Mr. Tapan Singh, Advocate, submitted that the applicant has been falsely implicated in the present matter. He was not present on the spot. He was taking dinner with his family at Bhaj Govindam Restaurant, situated at Kashipur-Ramnagar Road at the time of the alleged incident. The distance of the place of incident from the said restaurant is about 9 km. The Investigating Officer took the CCTV footage of the said restaurant. Applicant is a permanent resident of District Udham Singh Nagar. 5. Mr. Tumul Nainwal, Assistant Government Advocate, on instructions, submitted that the Investigating Officer had taken the CCTV footage of the said restaurant and as per the CCTV footage, the applicant was taking food in the said restaurant at the time of the incident. 6. Personal liberty under Article 21 of the Constitution of India is very precious fundamental right and it should be curtailed only when it becomes 2 2025:UHC:7391 imperative according to the peculiar facts and circumstances of the case. 7. Having heard the submissions of learned counsel for the parties and keeping in view of the facts and circumstances of the case, the present Application, filed for anticipatory bail, is allowed. It is directed that in the event of arrest of the applicant Harsh Simranjeet Singh, he shall be released on anticipatory bail on executing a personal bond of Rs. 30,000/ - and two reliable sureties, each of the like amount, to the satisfaction of the Arresting Officer, subject to the following conditions: - (i) Applicant shall cooperate with the Investigating Agency and he shall make himself available for interrogation by a police officer as and when required; (ii) If the charge-sheet is filed, the applicant shall attend the trial court regularly and he shall not seek any unnecessary adjournment; (iii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person, acquainted with the facts of this case; (iv) Applicant shall not leave the country without the previous permission of the trial court. 8.
