In view of the order proposed to be passed, issuance of notice to opposite party no.3 is dispensed with. 3. Learned counsel for the petitioner submits that restoration application dated 19.07.2023 in Case No.9454 of 2022, Computerised Case No.T202205440309454, Phulena Vs. Gaya and others, under Section 35 of U.P. Revenue Code, 2006 is pending before opposite party no.2 and the same has not been decided till date. He, therefore, prays that a direction may be issued to decide the same within the stipulated period. 4. Learned Additional Chief Standing Counsel does not have any objection if such direction is issued by this Court to decide the same as per law. 5. Writ petition is accordingly disposed of with a direction to opposite party no.2 to decide the aforesaid restoration application, say, within a period of three months from the date of production of a certified copy of this order after affording opportunity of hearing to the aggrieved parties without prejudice to their rights. .
