JUSTICE PARTHIVJYOTI SAIKIA ORDER Date :02.06.2025 Heard Mr. P. Das, learned counsel for the petitioners. Also heard Mr. M. R Boro, learned Standing Counsel, DRI. 2. This application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (B.N.S.S), 2023, in respect of NDPS Case No. 64/2023, pending before the Court of learned Additional Sessions Judge No.3, Kamrup (M), Guwahati. 3. 1112.33 gram of heroine was recovered from the possession of the petitioners and some other persons. One of them has already absconded and a case against him already been filed. As many as eight prosecution witnesses are shown in the charge- sheet and out of them two are already examined. 4. Mr. Das, has submitted that the petitioners have been in custody for more than 900 days. 5. According to Mr. Das, the prolong incarceration of the petitioners should be taken up as a ground for releasing them on bail. 6. I have considered the submissions made by learned counsel of both sides. 7. This Court is of the opinion that this is not a proper stage for consideration of the bail prayer of the petitioners. 8. Let the trial Court examine 2/3 more witnesses after that the petitioners shall have the liberty to approach this Court again for seeking bail. Page No.# 3/3 9. With the aforesaid directions, the present bail petition stands closed and disposed of. JUDGE Comparing Assistant
