Respondent(s) (Cause-title taken from Case Information System) For Petitioner : Ms. Aditi Singhvi, Advocate For State : Mr. Shreyansh Mehta, P.L. Hon'ble Shri Justice Amitendra Kishore Prasad VISHAKHA BEOHAR Digitally signed by VISHAKHA BEOHAR Date: 2025.05.08 12:47:38 +0530 2 Order on Board 07.05.2025 1. By this instant petition, the petitioner has prayed for following relief(s) : “1] That, this Hon'ble Court may kindly be pleased to quash the order dated 06.08.2021 passed by the Court of Tehsildar, Durg in Case No. 202108100700311 and direct the respondent No. 04 to carry out demarcation proceedings expeditiously. 2] That, this Hon'ble Court may kindly be pleased to set aside the order dated 09.11.2020 issued by the Respondent No. 02 as being arbitrary illegal and bad in law. 3] That, this Hon'ble Court may kindly be pleased to grant any other relief, which it deems fit and proper. ” 2. Learned counsel for the petitioner submits that although this petition was filed on 24.02.2022 with the relief that the respondent authorities be directed to demarcate the petitioner’s land as per her application, but the said application for demarcation was dismissed on the ground that the land in question is very small which is approximately 375 square feet and therefore, it is not feasible to carry out the demarcation. Furthermore, by another order, it was stated that the division of the land has not been reflected in the revenue map, and thus, demarcation is not possible. 3 3. Considering the facts and circumstances of the case, it is now possible to carry out the demarcation of the petitioner's land with the help of satellite technology, as the land in question can be identified using satellite image. This would assist in the proper demarcation of the land. In light of the above, the petitioner is directed to file a fresh application along with a copy of this order. The concerned authorities are directed to consider and decide the said application within a further period of four weeks from the date of receipt of such application, in accordance with law, taking assistance from satellite imagery, including Jio Satellite, or any other appropriate technology. 4. With the aforesaid observation(s) and direction(s), the present petition is disposed of. sd/- (Amitendra Kishore Prasad) Judge Vishakha
