The grievance of the petitioner is that respondent No.3 is not considering the appeal and interim application dated 06.03.2020 filed by the petitioner against the proceedings of the respondent No.4 in Rc.B.453/2019 dated 26.02.2020 and dated 27.02.2020. Seeking for writ of mandamus, this writ petition is filed.
2. Heard Sri G.Ramesh Babu, learned counsel for the petitioner, learned Assistant Government pleader for Revenue appearing for the respondents.
3. It is contended that respondent No.4 vide proceedings dated 26.02.2020, passed an order Under Section 7 of the A.P Land encroachment Act, 1905. It is further stated that vide the said appeal dated 06.03.2020, petitioner has also sought for suspension of the proceedings of the Tahsildar/4th respondent. Since the request made by the petitioner for suspension of the proceedings of the Tahsildar was not granted, this Court vide orders dated 17.03.2020, has suspended the proceedings of the 4th respondent dated 26.02.2020.
4. The learned counsel for the petitioner submits that the application of the petitioner is not yet been disposed.
5. Having regard to the facts and circumstances of the case, the present writ petition is disposed of. The respondent No.3 is directed to dispose of the appeal filed by the petitioner after giving sufficient opportunity to the petitioner, within two (2) months from the date of receipt of copy of this order. Pending disposal of the same, the petitioner shall not dispossess from the subject land. There shall be no order as to costs.
As a sequel, all pending miscellaneous applications shall stand closed.
