JUSTICE SUSMITA PHUKAN KHAUND ORDER 28.03.2025 Heard learned counsel, Mr M U Mondal, for the petitioner, Saha Alom, who has filed this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail, as he is behind bars since 21.02.2025, in connection with Bilasipara PS Case No. 51/2025, under Sections 316(2)/318(4)/336(3)/ 340(2)/3(5), of the BNS, 2023. Page No.# 2/2 2. Heard Mr K Baishya, learned Additional Public Prosecutor, Assam for the respondent State. 3. The allegation is basically against Safiqur Rahman, who has purchased a vehicle from the informant on hire-purchase basis. Thereafter, the registration number of the vehicle was changed fraudulently. The petitioner was arrested in connection with this allegation. 3. It is submitted that the petitioner is the registered owner of the vehicle and the zimma of the vehicle bearing Registration No. AS26AC2598, has already been handed over to the petitioner vide order dated 14.02.2025, passed by the learned SDJM, in connection with GR Case No. 432/2024, arising out of BLP Case No. 234/2024. The order is marked as Annexure-8. The petitioner has been given zimma of the aforementioned vehicle. 4. I have also considered the length of detention. 5. It appears that further custodial detention may not be required for the progress of investigation. 6. Considering all aspects, the petitioner is enlarged on bail on furnishing a bail bond of Rs. 30,000/- (Rupees Thirty Thousand Only) with a suitable surety of like amount to the satisfaction of the learned SDJM (M), Bilasipara, 7.
