Act), Jalaun at Orai, in Criminal Revision No. 169 of 2024 (Geetesh Dwivedi & Another vs. Arjun Singh & Another) and the impugned order dated 23.10.2024 passed by the learned Additional Civil Judge (Class II) / Fast Track Court / Additional Chief Judicial Magistrate, Jalaun at Orai, in Complaint Case No. 893 of 2018 (Arjun Singh vs. Geetesh Dwivedi & Another), under Section 138 of the Negotiable Instruments Act, 1881, P.S. Kotwali Orai, District Jalaun and directing the Learned Additional Civil Judge (Class II) / Fast Track Court / Additional Chief Judicial Magistrate, Jalaun at Orai and direct the Court below to take appropriate steps for obtaining the report of the hand writing expert of Forensic Science Laboratory, for verifying the signature on the cheque in question, due to inherent technical defect with liberty to file fresh. 2. Learned AGA has no objection to the same. 3. The present application is dismissed as withdrawn with liberty as aforesaid. 4. Certified copy of the documents be returned to the learned counsel for the applicants subject to furnishing of photocopy of the same.
