[2025:RJ-JP:26627] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Revision Petition No. 1156/2007 Smt. Kaushalya @ Kosha, wife of Rajendra Prasad, R/o Khava Raoji, District Dausa (Raj.) ----Petitioner Versus 1. Rajendra @ Om Prakash son of Radhey Shyam @ Angoori Lal, 2. Radhey Shyam @ Angoori Lal, son of Suraj Mal, 3. Shanti, wife of Radhey Shyam @ Angoori Lal, All residents of Ranoli, Police Station Manpur, District Dausa (Raj.) 4. State of Rajasthan, Through Public Prosecutor. ----Respondent For Petitioner(s) : None present For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 16/07/2025 1. No one appears on behalf of the petitioner. 2. The petitioner has challenged the acquittal order passed by learned Additional Chief Judicial Magistrate, Dausa, whereby the respondent was acquitted of the charges under Sections 498-A and 494 of IPC. 3. Learned trial Court in order to arrive at the findings considered the FSL report and the evidence put-forth before the Court and after elaborately discussing the statement of the witnesses reached to the conclusion that prosecution failed to establish beyond reasonable doubt the fact that the respondent demanded dowry and committed cruelty with the complainant. The fact that respondent No.1 entered into second marriage also [2025:RJ-JP:26627] (2 of 2) [CRLR-1156/2007] remain unproved as prosecution failed to adduced cogent evidence regarding solemnization of second marriage. Therefore, considering the above facts, I do not find any perversity in the findings arrived at by the learned trial Court. 4. Accordingly, the instant revision petition devoid of any merits, hence dismissed. (PRAVEER BHATNAGAR),J Ashwani Kr Srivastava /383
