By the present writ petition, the petitioner who is the owner of land bearing Survey no. 239/2 & 240/1, area respectively 0.1300 and 0.1200 hectare, situated at Village: Kurud P.H.N. 14/19, new No. 49 revenue inspector circle Durg Tehsil and District Durg (C.G.), seeking a direction towards the respondent authorities to permit the petitioner to sale the land owned by the petitioner. 2. Learned counsel for the petitioner submits that the petitioner is not making any illegal plotting on the land, however, the petitioner wish to sale the land owned by him within the permissible limit. 3. Learned counsel for the State, on instructions, would submit that if the petitioner wish to sell the land within permissible limit, then the State has no objection to the contention of the petitioner and he may sell the land owned by him within permissible limit of land transactions without any plotting. 4. I have heard learned counsel for the parties and perused the documents. 5. Perusal of the pleadings and documents, it is evident that the order of restriction of sale has been imposed by the authorities only to prevent illegal plotting. Since, the petitioner is stating that the petitioner wish to sell the total land owned by him within permissible limit of land transactions, there is nothing left to adjudicate, at this 3 stage and it is directed that the petitioner be permitted to sell his land without making any illegal plotting within permissible limit of land transactions.
