IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2217 of 2024 ------ Sonapati Tudu, aged about 50 years, Wife of Budai Hembrom, resident of Village –Koaam, P.O. Ramgarh, P.S. – Ramgarh, District –Dumka (Jharkhand) … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Suraj Singh, Advocate For the State : Mr. Shashi Kr. Verma, Addl. P.P. For the Informant : Mr. Sanjeev Thakur, Advocate : Mr. Jagat Soni, Advocate ------ Order No.04 Dated- 05.03.2025 Heard the parties. Apprehending her arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Ramgarh P.S. Case No.69 of 2022 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons has committed the murder of Dulari Tudu by throttling her neck because of land dispute between them. It is further submitted that the allegations against the petitioner are all false and there is no eye-witness to the occurrence. It is then submitted that the petitioner undertakes to cooperate with the investigation of the case. Hence, it is submitted that the petitioner be given the privilege of anticipatory bail. Learned Addl. P.P. and the learned counsel for the informant on the other hand vehemently opposes the prayer for bail and submits that the petitioner is absconding since the date of murder of the deceased –Dulari Tudu on 28.09.2022 and is not cooperating with the investigation of the case and the very fact that she is absconding is indicative of her active involvement in commission of murder of Dulari Tudu besides, there is direct and specific allegation against the petitioner in the F.I.R. itself. It is next submitted that the custodial interrogation of the petitioner is required during the investigation of the case in order to find out the details of the case. Hence, it is submitted that the petitioner ought not to be given the privileges of anticipatory bail. Considering the serious nature of allegation against the petitioner of committing the murder of Dulari Tudu as well as the requirement of her custodial interrogation during the investigation of the case, this Court is not inclined to give the privileges of anticipatory bail to the abovenamed petitioner. Accordingly, the prayer for grant of privileges of anticipatory bail of the above-named petitioner is rejected. (Anil Kumar Choudhary, J.) Sonu/Gunjan-
