A preliminary objection has been raised by learned Standing Counsel on the ground that eviction order has been passed against the petitioners which is under challenge. Petitioners had already filed recall application for recalling the order passed in proceedings under Section 67 of U.P. Revenue Code, 2006 which is pending consideration. 2. This Court finds that once recall application is pending consideration, no case for interference is made out. 3. Writ petition is misconceived and the same stands dismissed. 4. In case, recall application is pending consideration, revenue authority to proceed with recall application and decide the same strictly in accordance with law, within a period of one month.
