(2025:JHHC:16991) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 3752 of 2025 Jitendra Oraon @ Mantu, aged about 31 years, son of Dashu Oraon, resident of Village- Lawarpur, P.O. and P.S.- Latehar, District- Latehar (Jharkhand) … Petitioner - Versus - The State of Jharkhand … Opp. Party ------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH ----- For the Petitioner : Mr. Sahil, Advocate For the State : Mr. Someshwar Roy, A.P.P. --- 02/26.06.2025 Heard the parties. Petitioner has been made accused in connection with Special POCSO Case No. 10 of 2024 arising out of Latehar P.S. Case No. 236 of 2023 for the offences registered under sections 376(1), 376(2)(n) of the Indian Penal Code and sections 4 and 6 of POCSO Act, pending in the court of learned Special Judge POCSO, Latehar. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No.3437 of 2024 by order dated 14.05.2024. Petitioner is said to have forcefully established physical relationship with the victim who is aged about 12 years. Mr. Sahil, learned counsel for the petitioner has drawn the attention of this Court towards the statement of the victim recorded during the trial, from perusal of which, it appears that she has given a complete go-bye to the prosecution case, as such, she has been declared hostile. In view of the aforesaid facts, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge POCSO, Latehar, in connection with Special POCSO Case No. 10 of 2024 arising out of Latehar P.S. Case No. 236 of 2023. (Ambuj Nath, J.) Jay/-
