Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has assailed order dated 29.04.2021 (Annexure P-9), passed by the learned Trial Court, in terms whereof, an application filed by the petitioner for providing police assistance for implementation of the status quo order, was dismissed. 2. Perusal of the record demonstrates that during the pendency of these proceedings, this Court had ordered the demarcation of the suit land vide order dated 16.06.2021, by Tehsildar, Majhin, District Kangra, H.P. In light of the fact that the demarcation of the land has been carried out by the Tehsildar concerned, on the directions of this Court, this Court is of the considered view that it would be in the interest of justice, in case, this petition is disposed of without disturbing the order under challenge, but with the observation that the said demarcation report be placed on record of the learned Trial Court, it shall be construed to be a part of the record of the learned Trial Court and the parties to the suit be given an opportunity to file objections thereto and further proceedings be conducted by the learned Trial Court by taking into consideration the said demarcation report as well as objections thereto, if any, filed by the parties. 4. Ordered accordingly. The petition is disposed of in above-said terms, without disturbing the impugned order. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
