(ORAL) The present petition has been filed under Section 482 of BNSS, 2023 for grant of anticipatory bail to the petitioner in case FIR No.14 dated 05.03.2025, registered at Police Station Vigilance Bureau, District Patiala, under Sections 7-A, 13(1) ( 13(2) of the Prevention of Corruption Act, 1988 and Sections 167 and B IPC. On 11.09.2025, this Court had passed the following order:
“Learned counsel submits that the petitioner is a bona fide owner of the plot in question, with his two brothers namely Ram which they were granted no dues certificate and the said plot does not fall within the list of unauthorised colonies as notified by the Municipal Council, Sangrur and the requisite documents have been submitted and been paid at the time of filing of application and the same were granted in normal course of administrative procedure. The aforesaid two co-accused have already been granted interim anticipatory bail by th 07.07.2025 and have joined investigation and the matter is now listed for 22.09.2025. The petitioner is ready and willing to join the investigation as and

The present petition has been filed under Section 482 of BNSS, 2023 for grant of anticipatory bail to the petitioner in case FIR registered at Police Station Vigilance Bureau, A, 13(1) (A) read with Section 13(2) of the Prevention of Corruption Act, 1988 and Sections 167 and , this Court had passed the following order:-
Learned counsel submits that the petitioner is a bona the plot in question, which is inherited along with his two brothers namely Ram Gopal and Suresh, for which they were granted no dues certificate and the said plot does not fall within the list of unauthorised colonies as Municipal Council, Sangrur and the site documents have been submitted and charged had been paid at the time of filing of application and the same granted in normal course of administrative procedure. accused have already been granted interim anticipatory bail by this Court vide order dated 07.07.2025 and have joined investigation and the matter is for 22.09.2025. the investigating agency, who are otherwise in USA, shall reach India on 19.09.2025 and will cooperate. Notice of motion. At the asking of the Court, Mr. M.S. Bajwa, DAG Punjab accepts notice on behalf of respondent-State. Meanwhile, the petitioner is directed to join the investigation on 20.09.2025. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482 (2) BNSS.” However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated. Adjourned to 22.09.2025.”

Learned counsel submits that in pursuance of the afore- mentioned order, the petitioner has not only joined investigation but also fully cooperated with the investigating agency. He further submits that in case the investigating agency requires the petitioner to appear, he shall make himself available without demur.

Learned State counsel on instructions from SI Gurlabh Singh affirms the factum of joining the investigation by the petitioner and cooperating with the investigating agency. He also submits that at this stage, the petitioner is not required for further custodial interrogation.

In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 11.09.2025 granting interim bail to him, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to him.
