Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. By means of the present writ petition, the petitioner has prayed for the following relief(s): "(i) Issue a writ order or direction in the nature of Mandamus commanding and directing the respondent No.2 and 4 to prevent the newly formed society for marketing purpose for participating in reviser tender processing/auction proceeding issued from office of District Magistrate, Auraiya on 04.08.2025 will be held on 22.09.2025. (ii) Issue a writ order or direction in the nature of Mandamus commanding and directing the respondnet No.2 to conduct the auction proceeding for hunting of fishes published on 04.08.2025 issued from District Magistrate, Auraiya according with law." 3. The petitioner contends that societies constituted for the purpose of marketing are barred from participating in the tender process for grant of Fisheries Rights, and in this backdrop, the petitioner has sought the aforesaid relief. 4. There is nothing on record to indicate that any such society has participated in the tender process, however, according to the petitioner, at Versus Counsel for Petitioner(s) : Kundan Kumar Counsel for Respondent(s) : C.S.C. Matsya Jivi Sahkari Samiti Limited .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) present no tender has been floated for the purpose of Fisheries Rights. 5. In such view of the fact, the writ petition is pre-mature as no cause of action has accrued to the petitioner as of today.
