Munir for the petitioner Akram Ali @Akram Hussain @Akrom Ali. 2. The petitioner has filed this application under Section 483 of the BNSS, Page No.# 2/3 2023 with prayer for bail as he is behind bars since 16.03.2025 in connection with Geetanagar Police Station Case No. 20/2025 under Sections 303(2) of the BNS. 3. Heard Mr. D. P. Goswami, learned Additional Public Prosecutor, Assam for the respondent State. 4. I have considered the submissions at the Bar. The petitioner has been behind bars since 16.03.2025. 5. The allegation against the petitioner is that he has committed theft of a water meter. 6. The learned Trial Court has rejected the bail application of the petitioner and the petitioner is before this Court. 7. It appears that investigation may have presumably progressed to some extent. It appears that further custodial detention may not be required for the progress of investigation. 8. Considering all aspects, petition is allowed. The petitioner shall be enlarged on bail on furnishing a bail bond of Rs. 30,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Kamrup, (M) under the conditions that: (i) The petitioner shall appear before the Investigating Officer on every fortnight till completion of investigation, (ii) The petitioner shall refrain from such activities with which he is alleged, and (iii) The petitioner shall not leave the jurisdiction Page No.# 3/3 of the Court without prior permission. 9. On breach of any of the bail conditions, the Jurisdictional Court/Elaka Magistrate is at liberty to immediately cancel the bail granted to the petitioner. 10.
