Proceeding for eviction was initiated against the petitioner on the ground that he is in unauthorized possession of Gata No. 747, which is recorded as pond in the revenue records. Petitioner has encroached upon the land of Gaon Sabha and eviction order was passed. Petitioner had filed an appeal, which has been dismissed by the order impugned. 2. I have heard respective counsel for the parties and perused the material on record. 3. From perusal of the survey map, annexed as annexure no. 1 to the writ petition, it is clear that khasra no. 747 has been recorded as Johad and encroachment of petitioner stands on the said land of pond. Petitioner could not make out any case and has only relied upon the revenue entry of Fasli Year 1425-1430 wherein the land mentioned as khasra no. 747M, which was earlier recorded as abadi, by order dated 10.11.2020 in proceeding under Section 38 (2) of U.P. Revenue Code, 2006 has been corrected to be recorded as land of Gaon Sabha as pond. 4. The aforesaid revenue entry was never challenged by petitioner and same stands till date. In view of the said fact as petitioner is in possession of land of Gaon Sabha, which is recorded as pond, no case for interference is made out.
