This writ petition has been filed with the following prayer:- "(a) Issue a writ, order or direction in the nature of Mandamus commanding/ directing the respondent No.2- Sub-Divisional Magistrate, Tehsil Sadar, District Mainpuri to decide the application dated 23.01.2017 filed by the petitioner in Case No. 280 of 2006 State Vs. Rakesh Singh, under Section 33/39 of U.P. Land Revenue Act pending before him expeditiously or within the stipulated period as may be fixed by this Hon'ble Court (Annexure No. 4 to this writ petition)." 2. It is contended by learned counsel for the petitioner that proceedings under Section 33/39 of U.P. Land Revenue Act are pending consideration before respondent no. 2 since 2006. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon respondent no. 2 to decide the Case No. 280 of 2006 State Vs. Rakesh Singh, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
