In this petition, petitioner herein has challenged the Technical Evaluation Report dated 14.11.2025 issued by respondent no. 3 regarding construction of Road Dabraj to Moh. Banyian Pyt. Dabraj Block Mankote (S. No. 19), pursuant to tender No. e-NIT 162 of REW dated 18.10.2025, by virtue of which the technical bid of the petitioner was rejected as “not admitted”. 02. Learned counsel for the petitioner states that similar documents submitted by the petitioner have already been considered and admitted by the respondents at serial nos. 17 and 18, and the petitioner’s technical evaluation was shown as responsive. 03. Mr. Raman Sharma, learned AAG, has produced a copy of the communication dated 26.12.2025, which is taken on record, stating that the issue raised by the petitioner has been duly addressed by the department, rejection of the technical bid of the petitioner had 18 2 WP(C) NO. 3578/2025 occurred due to a technical error. Consequently, the petitioner stands qualified for the financial bid. 04. In view of the above statement made by Mr. Raman Sharma, learned AAG, Mr. Anil Gupta, learned counsel for the petitioner, seeks withdrawal of the present petition.
