Heard the parties.
The petitioner has been made accused in connection with Bankmore P.S. Case No. 63 of 2022, S.T. Case No.620 of 2022, for the offence registered under Sections 341, 323, 307, 326, 498-A, 504, 506 & 509 of the Indian Penal Code and Sections 3/4 of D.P. Act, pending in the court of learned Additional Sessions Judge-III, Dhanbad.
Bail application of the petitioner was earlier rejected by the Coordinate Bench of this Court.
Petitioner happens to be the brother-in-law of the deceased Sony Perveen, who died in her matrimonial home due to burn injuries.
While granting bail to co-accused Santana Parveen @ Sultanat Bano @ Saltanat Bano @ Santna Parveen, this Court had occasion to go through the case diary. It appears that the statement of a witness has been recorded, in which, it has been stated that the victim has stated before him that while she was igniting the stove for cooking, she caught fire and sustained burn injuries.
In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III, Dhanbad, in connection with Bankmore P.S. Case No. 63 of 2022, S.T. Case No.620 of 2022.
