Hearing concluded on : 24.02.2026 Judgment on : 24.02.2026 SAUGATA BHATTACHARYYA, J.: 1) Affidavit of service and supplementary affidavit filed on behalf of the petitioner are taken on record. 2) Petitioner participated in the selection process for being appointed as Constable (GD) in Central Armed Police Forces (CAPFs). P a g e | 2 Petitioner qualified in written test but in Review Medical Examination conducted on 26th November, 2025 petitioner was declared unfit due to carrying angle. Placing reliance on medical report dated 1st December, 2025 issued by a Physician of IPGME & R – SSKM Hospital, Kolkata and another report dated 3rd February, 2026 issued by a Physician of IQ City Medical College Hospital, Durgapur it is submitted by learned advocate representing the petitioner that Review Medical report dated 26th November, 2025 does not reflect correct health condition of the petitioner. According to the petitioner, though medical experts of Review Medical Board opined that petitioner has carrying angle in respect of left hand 21 degree and in respect of right hand 13 degree but same is not supported by aforesaid two medical documents obtained by the petitioner from two different Hospitals. Reliance is also placed on another medical document dated 15th December, 2025 issued by a Physician of Asansol District Hospital. 3) Union of India is represented by Ms. Alam, learned advocate, who opposes the writ petition based on clause 9 (VII)(2)(a) of the revised Guidelines for Recruitment Medical Examination in Central Armed Police Forces and Assam Rifles of May, 2015 wherein carrying angle as one of the upper extremities is defined. It is submitted that in case of male candidate within the range of 10 to 15 degree angle is permissible. It is contended that in Review Medical Examination report dated 26th November, 2025 it is disclosed angle of left hand of the petitioner is 21 degree which is above the prescribed limit. P a g e | 3 4) Report of Physician of IQ Medical College Hospital, Durgapur dated 3rd February, 2026 is also disputed since it is a private establishment and such report is not in tune with other two reports dated 1st December, 2025 and 15th December, 2025 issued by Physicians of IPGME & R – SSKM Hospital, Kolkata and Asansol District Hospital respectively. 5) Petitioner was declared unfit in Review Medical Examination held on 26th November, 2025 on the ground of carrying angle. In respect of right hand angle was measured 13 degree but in respect of left hand it was measured 21 degree. In order to find out whether petitioner is medically fit candidate to be appointed as Constable (GD) under CAPFs Court needs to rely upon clause 9 (VII) (2)(a) of the revised Guidelines of May, 2015. It is provided in clause 9 (VII) (2)(a) under the heading “Normal angle” that 10 to 15 degree is permissible angle for male candidates and candidates with carrying angle upto 20 degree may be accepted if the same is not associated with abnormality of elbow joint. Hence, as in the Review Medical Examination carrying angle of left hand was measured 21 degree same is above the prescribed limit taking note of the clause 9(VII)(2)(a) of revised Guidelines of May, 2015. 6) Medical document dated 1st December, 2025 issued by the Physician of IPGME & R – SSKM Hospital, Kolkata and another medical document dated 15th December, 2025 issued by the Physician of Asansol District Hospital do not disclose carrying angle of left hand of the petitioner. Therefore, fitness of the candidate P a g e | 4 ought not to be assessed based on those two medical documents specially when medical fitness needs to be assessed on the anvil of the provisions as contained in the revised guidelines of May, 2015. 7) An attempt has been made on behalf of the petitioner to substantiate his case based on another medical document dated 3rd February, 2026 issued by the IQ City Medical College Hospital, Durgapur wherein measurement of angle in respect of both hands of the petitioner are disclosed but same is not in consonance with the two other reports dated 1st December, 2025 and 15th December, 2025 issued by Physicians of IPGME & R – SSKM Hospital, Kolkata and Asansol District Hospital respectively. Moreover, Court is not inclined to rely upon the report issued on behalf of IQ City Medical College Hospital, Durgapur since same is a private establishment. 8) In aforesaid conspectus, no relief can be granted to the petitioner. 9) Writ petition stands dismissed. 10) There shall be, however, no order as to costs. 11) Urgent photostat certified copy of this judgment and order, if applied for, be given to the parties on usual undertaking.
