JUSTICE ARUN KUMAR JHA ORAL ORDER 2 25-09-2025 Heard learned counsel for the petitioners and learned APP for the State. 2. In the present case, the petitioners seek bail in connection with Barachatti P.S. Case No. 262 of 2025 registered on 20.07.2025 for the offences under Sections 308(2) and 308(4) of the BNS. 3. As per prosecution case, petitioners and co-accused were found extorting money from the vehicle owners near a toll bridge. 4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. Recovery of Rs. 400 and Rs. 500, respectively was made from the petitioners along with Patna High Court CR. MISC. No.69320 of 2025(2) dt.25-09-2025 2/3 their motorcycles. It is a case of out and out false implication. There is no complainant who have said that the petitioners were extorting money from them. It is not believable that petitioners were extorting money near toll bridge where police and other officials are always present. Petitioners have been made accused in this case due to highhandedness of the police personnel and village politics. Petitioner no.1 is having antecedent of two cases whereas petitioner no.2 is having one criminal antecedent and they are on bail in all the cases. Petitioners are in custody since 21.07.2025. 5. Learned A.P.P. opposes the submission made on behalf of the petitioners. 6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the dubious nature of allegation against the petitioners and also considering the period of custody of the petitioners, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned ACJM-1, Sherghatti, Gaya/concerned court in connection with Barachatti P.S. Case No. 262 of 2025, subject to the conditions mentioned in Section 480(3) of the Patna High Court CR. MISC. No.69320 of 2025(2) dt.25-09-2025 3/3 B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioners. (ii) The petitioners will remain present on each and every date fixed by the court below.
