JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 24-09-2025 Heard learned counsel for the petitioners and the State . 2. Petitioners apprehends arrest in a case registered for the offence punishable under sections 25 (1-b)/a/26/35 of Arms Act. 3 . As per the prosecution case , informant namely , Rajiv Ranjan alleged that on 22.02.2025 , he received a secret information that some miscreants have assembled in Community Hall at Saiya Dera to commit a crime . Upon such information , informant along with other police personnel conducted a raid on the spot and upon seeing the police Patna High Court CR. MISC. No.68008 of 2025(2) dt.24-09-2025 2/2 officials, these petitioners fled away from the place of occurrence . On search , two country made pistols, five live cartridges and four empty cartridges were recovered from the spot. 4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case only on the basis of suspicion . No arms and ammunition was recovered from the conscious possession of this petitioner. 5. Learned counsel for the State opposes the prayer for bail and submitted that petitioners are named in the F.I.R. and have got 4 criminal antecedents of similar nature . 6. Considering the nature of accusation , criminal antecedents of these petitioners and other circumstances of the case , prayer for pre-arrest bail of the petitioners is rejected.
