Heard the counsel for the petitioner and the A.G.A. for the State. The present petition has been filed challenging the First Information Report dated 2.9.2025 registered with Case Crime No. 180 of 2025, under sections 316(5), 319(2), 318(4), 338, 336(3) and 340 (2) of B.N.S., Police Station Ashothar, District Fatehpur. It has been brought to our notice that vide orders dated 17.09.2025 and 18.09.2025 passed in Criminal Misc. Writ Petition Nos. 20971 of 2025 and 21058 of 2025, filed by some other co-accused, this Court has granted protection to the petitioners in the said writ petitions. It would be appropriate in the interest of justice that similar protection be granted to the petitioner. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the First Information Report registering Case Crime No. 180 of 2025, under sections 316(5), 319(2), 318(4), 338, 336(3) and 340 (2) of B.N.S., Police Station Ashothar, District Fatehpur till submission of the police report under Section 193 of Bhartiya Nyaya Sanhita, 2023.
