JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 5 25-09-2025 Heard learned counsel for the petitioners as well as the learned APP for the State. 2. The petitioners apprehend their arrest in connection with Laukahi (Narhiya O.P.) P.S. Case No. 287 of 2022 registered for the offences punishable under Sections 448,341, 323, 354, 307, 379, 504, 34 of the IPC. 3. As per allegation, the petitioners along with other co- accused persons abused and assaulted the informant and her family Patna High Court CR. MISC. No.6149 of 2025(5) dt.25-09-2025 2/3 members with lathi, danda, khanti etc. due to which they got injured. It is further alleged that the accused persons looted Rs. 3,000/-. 4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. He fairly submits that there is specific allegation on petitioner no. 3 that he along with other co-accused persons have badly assaulted the father-in-law of the informant and during medical treatment, he got 11 stitches. He has further submitted that there is general and omnibus allegation against petitioner nos. 1, 2, 4 and 5. 5. Learned APP for the State has opposed the prayer for bail. 6. Considering the above-mentioned facts and circumstances and the fact that there is genral and omnibus allegation against petitioner nos. 1, 2, 4 and 5, let the petitioner nos 1, 2, 4 and 5, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Jhanjharpur, Madhubani in connection with Laukahi (Narhiya O.P.) P.S. Case No. 287 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, Patna High Court CR. MISC. No.6149 of 2025(5) dt.25-09-2025 3/3 2023. 7. So far as petitioner no. 3 is concerned, there is specific allegation against him that he has badly assaulted the father-in-law of the informant, so, he does not deserve the privilege of anticipatory bail.
