Heard Shri Jitendra Singh, learned counsel for the petitioners, Shri Fuzail Ahmad Ansari, learned Standing Counsel for the State-respondents and Shri Abhinav Krishna Srivastava, learned counsel for respondent – Kanpur Development Authority (KDA). 2. This writ petition has been filed praying inter alia for the following relief: "a) Issued an appropriate writ, order or direction in nature of mandamus direction to the respondent no. 2 to 3, that do not dispossess from petitioner's Bhumidhari land bearing Arazi no. 318, 376 situated at Barra-8, Kanpur Nagar and may be further pleased to especially restrain to the respondent no. 4 by means of an ad-interim direction into the light of govemment order dated 31.01.2023 and 11.03.2023 issued after interference by this Hon'ble Court order dated - 14.12.2022 and 16.02.2023." 3. After substantial arguments, once this Court finds that in the event of any violation of the injunction order, the petitioners have an efficacious remedy available under Order XXXIX Rule 2A C.P.C. In view thereof, we are not inclined to entertain the writ petition on merits. At this stage, the learned counsel for the petitioners submits that the petitioners do not want to press the present writ petition. Accordingly, the writ petition stands dismissed as not pressed.
