The petition coming on for hearing, upon perusing the petl'tjon and the grounds filed in support thereof and upon hearing the arguments of sri ADAPA SUDHAKAR RAO, Advocate for the pet[tl-oner and of PUBLIC PROSECUTOR for the Respondent and the court made the following; ` ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity {the BNSS'), seeking to enlarge the petitioner/Accused No.2 on bail in Cr.No.240 of 2024 on the file of Government Railway Police Station, Palasa, registered against the petitioner/Accused No.2 herein for the offence punishable under Section 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity [the NDPS Act]). 2. The case of the prosecution in nutshell is that on 06.12.2024 the Sub-Inspector of Police, Government Railway Police Station, Pa'asa, received information about the illegal possession and transportation of ganja through Sompe{a Railway Station and he secured the presence of mediators and rushed to the foot over bridge on Platform No.2, where he noticed six persons with five luggage duffel bags and two backpack bags. The Sub Inspector of Police along with his staff apprehended Al and A2 while ,the other four persons escaped from there. During the investigation] it was disclosed that 118 kgs of ganja was seized under the cover of mediators report. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. u-ut e€ 4' Learned counsel for the petitioner submits that the petitioner has not committed any offence; petitioner was falsely imp]jcated by the police I-n the crime; petitioner is the sole breadwinner; petitioner would abide by any conditions to be imposed by this court; and urged to allow the petition. 5' Per confra, theJlearned Assistant Public Prosecutor, opposed the bail application statI'ng that some more material Witnesses have tO be examined; investigation is not completed; if the petitioner is enlarged on bail, he would not be available for the investigation and he would escape 8. ln the result, the criminal petition is allowed with the following /; conditions: (i) To, The petitioner shall execute personal bond for Rsl10,000/- (Rupees Ten Thousand Only) with two sureties for like sum to the satisfaction of learned Special Judge for trial of offences under NDPS Act - Gum- I Additional District and sessions Judge, Srikakulam. (ii) The petitioner is directed to appear before the Government Railway Police Station, Palasa, on every 2nd Saturday and 4th Saturday between 10.OO a.m. to 05.00 p.m., till filing of the charge sheet.
