GP FOR REVENUE (AP) 3 HBKM,J W.P.No.6843 of 2020 The Court made the following Order:- Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondent Nos.1 to 4. 2. This writ petition was filed questioning the action of the respondent Nos.2 to 5 in trying to issue house site pattas to the third parties under the welfare scheme in Sy.No.188 to an extent of Ac.0.93 cents of Garikivalasa Village, Gurla Mandal, Vizianagaram District, which is classified as “Rastha”. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that in G.O.Ms.No.558 dated 02.03.2020, Panchayat Raj & Rural Development (Pts.II) Department “In large public interest, hereby decided to de-notify certain Poramboke lands i.e., Bandidari, Kalidari, Donka, Gaalu, Road Poramboke, Konda Gutta Poramboke, Rathistalamu, Paylikana, Banjaru, Taluka Board President etc. (which are not being used for the purposes prescribed and have identified by the District Collectors suitable for allotment as the house sites for the poor), under sub-section 2 of Section 58 of the Andhra Pradesh Panchayat Raj Act, 1994 (Act No.13 of 1994) in the State, which are vested with the Grampanchayat under sub section 1 of Section 58 of the said Act and accordingly, powers are delegated to the District Collectors for notifying the lands for the homeless poor under the welfare scheme of the State. 4 HBKM,J W.P.No.6843 of 2020 4. 4 HBKM,J W.P.No.6843 of 2020 4. She further submits that, the 4th respondent developed the Government vacant Rasta Poramboke for issuing of house sites duly providing roads between the plots without disturbing the Existing Road to approach the Agricultural fields of the writ petitioners and they are not disturbing with the providing of the layout for transportation of machinery and yields from the agricultural fields located adjoining to the proposed layout. There is a road provided to the petitioners’ agricultural fields also. 5. In view of the above said facts and circumstances, no further orders are necessary in this writ petition, as the petitioners are not evicted with the proposed layout and for the allotment of the house sites under the welfare scheme of the State. 6. Accordingly, this Writ Petition is disposed of. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
