A preliminary objection has been raised by Shri Diptiman Singh, counsel appearing for the respondent as to the maintainability of the transfer application on the ground that the matter relates to industrial dispute and there is specific provision under Section 33-B of the Industrial Disputes Act, 1947, for moving the application before the appropriate Government. 2. Learned counsel for the applicant states that already an application under the required format has been moved on 03.09.2025 before the Defense Secretary, Government of India, which is pending consideration. 3. In view of the said fact, the transfer application filed under Section 24 C.P.C. is not maintainable. 4. The transfer application is dismissed.
