Heard Sri Brij Raj, learned counsel for the petitioner and learned Standing Counsel for the State. 2. By means of this petition filed under Article 226 of the Constitution petitioner has prayed for quashing of the notice dated 20.12.2024 passed by Regional Forest Officer, Mirzapur. 3. Per contra it is submitted by learned Standing Counsel that petitioner has challenged the show cause notice and that too when it was issued way back in December, 2024. It is submitted the petitioner could have submitted his reply which would have been considered by the concerned forest officer. 4. We have perused the show cause notice dated 20.12.2024 and upon pointed query being made learned counsel for the petitioner very fairly concedes that till date no demolition exercise has been undertaken by the authorities pursuant to the notice in question. 5. In view of the above therefore we consider the notice dated 20.2.2024 to be only a notice and in the circumstances, we dispose of this petition with a direction to the petitioner to submit his reply to the notice dated 20.12.2024 within a period of four weeks from today and in the event petitioner submits any reply as directed hereinabove, the concerned officer, namely, Regional Forest Officer, Mirzapur Range, Mirzapur shall dispose of the matter of notice dated 20.12.2024 by means of a reasoned Versus Counsel for Petitioner(s) : Brij Raj, Ramsagar Yadav Counsel for Respondent(s) : C.S.C. Sumantha @ Sumant Mishra .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) and speaking order within a further period of two months.
