HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 33863 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J. HON'BLE SWARUPAMA CHATURVEDI, J. 1. Heard Sri Shailesh Kumar, learned counsel for the petitioner and Sri Pradeep Kumar Sahi, learned Additional Chief Standing Counsel for the State respondents. 2. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for following relief: "I). Issue a writ, order or direction in the nature of mandamus directing the respondents to dispossess the encroachment over the Chak Road situated Village Pataura, Paragna and Tahsil - Kerakat, District - Jaunpur." 3. In the considered view of the Court, this is a relief claimed for illegal encroachment on chak road in village Panchayat and hence appropriate remedy for the petitioner to apply for an action against the encroacher under Section 67 of the U.P. Revenue Code, 2006. 4. In view of the above, we decline to grant indulgence in the matter. 5. However, liberty rests with the petitioner to apply before competent authority under Section 67 of the U.P. Revenue Code, 2006, if so advised.
