Upon coming of this matter for consideration, the learned counsel for the petitioner would submit though the issue involved in the instant matter is amenable to the jurisdiction of Armed Forces Tribunal (AFT), Jammu Bench, however, the said Bench is presently on vacation and that since the petitioner is being sought to be discharged by the respondents on 26.12.2025 the instant writ petition would be rendered infructuous. 2. In view of the above, the instant writ petition is taken up for consideration. 3. Issue notice to the respondents, returnable within a period of four weeks. Requisite for the same be taken within a period of one week. 4. The present position of the petitioner be not disturbed till 5th of January, 2026. The further extension of the aforesaid interim order shall remain subject to the passing of any further/fresh orders by the Tribunal. Sr. No. 183 2 5. In the meantime, Registry is directed to transfer the instant petition along with the record to the Armed Forces Tribunal (AFT), Jammu Bench for adjudication, where the parties shall appear on 05.01.2026. 6.
