This writ petition has been filed with the following prayer:- "A) Issue a writ, order or direction in the nature of mandamus directing the respondent No.2; Sub-Divisional Magistrate, Tehsil Phoolpur, District Prayagraj to decide the Case No. 03 of 2024, Mohd. Isha versus Bhagwandeen and others, under section 32/38 of Uttar Pradesh Revenue Code, 2006 pending in the Court of Sub- Divisional Magistrate, Tehsil - Phoolpur, District Prayagraj, expeditiously within stipulated time period as may be fixed by the Hon'ble Court strictly in accordance with law." 2. It is contended by learned counsel for the petitioner that the proceedings under Section 38 of the U.P. Revenue Code, 2006, is pending consideration before the respondent no. 2. The sole prayer made is for expeditious disposal of the same. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, without calling for counter affidavit, with a direction to the respondent no. 2- Sub-Divisional Magistrate, Tehsil Phoolpur, District Prayagraj to decide the Case No. 03 of 2024 (Mohd. Isha versus Bhagwandeen and others), in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits. September 25, 2025 A. V.
