HIGH COURT OF JUDICATURE AT ALLAHABAD PUBLIC INTEREST LITIGATION (PIL) No. - 2999 of 2025 Chief Justice's Court HON'BLE ARUN BHANSALI, CHIEF JUSTICE HON'BLE KSHITIJ SHAILENDRA, J. 1. Petition has been filed seeking action against the respondent nos. 5 & 6 alleging embezzlement of Government money by the said respondents. 2. Counsel for the respondents with reference to the Uttar Pradesh Employment Guarantee Grievance Redressal Mechanism Rules, 2009 (for short, 'the Rules of 2009') submits that petitioner can always approach the competent authority under the said Rules and filing of the PIL for the purpose is wholly unnecessary and, therefore, the petition deserves dismissal. 3. A perusal of the Rules of 2009 reveals that under Rule 8, a complaint may be sent by Post or by Fax also. Once, the petitioner has made complaints on 15.07.2025 and 14.08.2025, the respondents can always entertain the said complaints under the Rules of 2009 and proceed accordingly. Not taking of any action by the respondents cannot be sustained. 4. The respondents-competent authority is directed to register the complaint as filed by the petitioner and investigate the same in accordance with the Rules of 2009. 5. Petitioner, if advised, may also make a fresh application to the Versus Counsel for Petitioner(s) : Jagadish Prasad Yadav Counsel for Respondent(s) : Jagdish Pathak, S.C. Sunil Patel .....Petitioner(s) State of U.P. and 5 others .....Respondent(s) competent authority under Rule 8 of the Rules of 2009. 6. With the above observations, the petition stands disposed of.
