Land Acquisition Collector, HPPWD & Ors. Vs. Premi Devi CMP(M) No.1328 of 2023 07.05.2025 Present: Mr. B.N. Sharma, Mr. Diwakar Dev Sharma and Mr. Raj Kumar Negi, Addl. Advocates General with Mr. R.P. Singh and Mr. Manish Thakur, Dy. Advocates General, for the applicants/State. CMP(M) Nos.750 and 751 of 2024 Despite service, none has put in appearance on behalf of the legal heirs of deceased respondent No.1 i.e. proposed LRs No.1(a), 1(c) to 1(f). Proposed 1(b) is stated to have died. For bringing on record the LRs of deceased proposed LR No.1(b), other applications have been filed. From a perusal of CMP(M) No.750 of 2024, it is evident that the sole-respondent had died on 19.05.2019. The details of legal heirs of deceased sole respondent are mentioned in para 4 of CMP(M) No.750 of 2024. The same is in consonance with legal heir certificate appended along with the present application. The right to sue survives in the said legal heirs. For the sufficient cause shown in CMP(M) No.751 of 2024, delay in bringing on record LRs of sole respondent is condoned and abatement, if any is set aside. The legal heirs of sole-respondent are ordered to be brought on record. Applications stand disposed of. CMP(M) Nos.2032 and 2033 of 2024 Despite service, none has put in appearance on behalf of the legal heirs of deceased proposed LR No.1(b). The other non-applicants do not intend to file any reply and have no objection, if in case the present applications are allowed and legal heirs of deceased proposed LR No.1(b) are ordered to be brought on record. Proposed LR No.1(b) is stated to have died on 05.04.2024. The details of legal heirs have been given in para 4 of CMP(M) No.2032 of 2024. The same is in consonance with the legal heir certificate appended with the present application. The right to sue survives in the said legal heirs. For the sufficient cause shown in CMP(M) No.2033 of 2024, delay in bringing on record LRs of deceased proposed LR No.1(b) is condoned and abatement, if any, is set aside. Legal heirs of proposed LR No.1(b) are ordered to be brought on record. Amended memo of parties filed along with the application is ordered to be taken on record. Application stands disposed of. CMP(M) No.1328 of 2023 Let fresh steps for the service of newly added respondents be taken within one week. On taking such steps, issue notices to them, returnable within four weeks. List thereafter.
