The petitioner, namely, Prem Gogoi, son of Jatin Gogoi, resident of Village-Ganeshyam Basti, Near Nepali Basti, 13th Mile, P.S. Basistha, District-Kamrup (Metro), has filed this application under Section 483 of BNSS, 2023, on 25.03.2025, praying for his bail in NDPS Case No. 58/2024 arising out of Basistha Police Station Case No. 539/2023 under Sections 21(C)/29 of NDPS Act corresponding to G.R. No. 6740/2023, trial of which is presently pending before the Court of learned Special Judge (NDPS), Kamrup (Metro), Guwahati, wherein he was arrested on 09.09.2023 and is in custody since then. 3. On instruction of the petitioner, Ms. Kiba, learned counsel prays for withdrawal of this bail application to which Mr. Parashar, learned Additional Public Prosecutor, Assam has no objection. 4.
