The Criminal Petition, u/Sec.480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A1 to grant regular bail in connection with Crime No.46/2025 of Visakhapatnam GRP Vijayawada. 2. A case has been registered against the petitioner herein and another for the offences punishable u/Sec.20(b)(ii)(B) r/w 8(c) of NDPS Act. 2
3. The case of the prosecution in nut shell is as follows:
On 10.02.2025 in between 12.30 pm and 2.30 pm, on receipt of credible information about illegal possession and transportation of ganja, the Sub-Inspector of Police, GRP Visakhapatnam, along with staff and mediators conducted search in Visakhapatnam Railway station plat form no.4 and 5 and found one person in suspicious circumstances. On enquiry, he disclosed his identity particulars as that of A1 and police found 7 kgs of ganja in his possession. He was arrested, seized the contraband and produced him before the Court for judicial remand. He confessed the involvement of A2 in the commission of the offence. 4. Heard Sri G.Maheswara Rao, learned counsel for the petitioner/A1 and Sri Neelothpal Ganji, learned Assistant Public Prosecutor for the respondent. 5. Learned counsel for the petitioner would submit that the petitioner has been in judicial custody from 10.02.2025 and the seized quantity is non-commercial quantity and prays to allow the criminal petition. 6. Contra to the same, learned Assistant Public Prosecutor vehemently opposed the petition stating that inventory is pending in this matter and even though the seized contraband is non-commercial quantity but the criminal petition is premature one as the statutory period was not completed and prays to dismiss the criminal petition. 3

Considering the submissions made and on perusal of the material on record shows that, as learned Assistant Public Prosecutor has rightly pointed out that the seized contraband is non-commercial quantity but the statutory period was not completed and the bail application is a premature one, this Court is not inclined to grant bail to the petitioner at this stage, as the investigation is going on. 8. In the result, the criminal petition is dismissed. Consequently, miscellaneous applications pending, if any, shall stand closed. _____________________________________
