In this revision petition, the tenant challenges the correctness of the order passed by the Appellate Authority while assessing the amount of mesne profit @ Rs.10,000/- per month with respect to a shop located in Amritsar City. The petitioners were ordered to be evicted by the Rent Controller. They filed an appeal, in which the landlord filed an application for assessing the mesne profits for use and occupation of the premises which is equivalent to the market rent. In order to prove the same, the landlord produced as many as three lease deeds to prove that the rate of rent of the nearby shops was between Rs.12,000/- to Rs.20,000/-. 2. Per contra, the tenants produced some rent deeds which were of 2015 and 2019. 3. The amount of mesne profits is required to be assessed in the year 2024. The Appellate Authority after considering all aspects of the matter, proceeded to assess Rs.10,000/- which is only payable during the pendency of the appeal.
