HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 21824 of 2025 Court No. - 42 HON'BLE J.J. MUNIR, J.
HON'BLE PRAMOD KUMAR SRIVASTAVA, J.
1. Heard Mr. Surya Prakash Tripathi, Advocate holding brief of Mr. Naveen Singh, learned Counsel for the petitioner and Mr. Shashi Shekhar Tiwari, learned Additional Government Advocate appearing on behalf of the State.
2. The submission of learned Counsel for the petitioner is that the petitioner has no role in the incident and has been falsely implicated. He is a resident of another village and a juvenile, aged 15 years and nine months.
3. We have perused the prosecutrix's statement recorded under Section 183 of the Bharatiya Nyaya Suraksha Sanhita, 2023, where the petitioner has been credited with the role of gang rape along with other two co- accused, after abducting the prosecutrix. The fact that the petitioner is a juvenile is not at all relevant to the plea of quashing the impugned First Information Report ('FIR' for short). The petitioner would have his remedies under the Juvenile Justice (Care and Protection of Children) Act, 2015, if he is below 16 years or 18 years, as the case may be.
4. No case for interference with the impugned FIR is made out.
5. This writ petition stands dismissed. September 24, 2025 I. Batabyal Versus Counsel for Petitioner(s) : Naveen Singh Counsel for Respondent(s) : G.A. (Pramod Kumar Srivastava,J.) (J.J. Munir,J.)
