The applicant has assailed the order dated 06.09.2024 passed by learned Special Judge, SC/ST Act, Bhadohi, Gyanpur whereby application moved by the complainant under Section 173(4) of BNSS has been rejected. Shri Moti Lal, learned AGA for the State has raised preliminary objection qua maintainability of the instant application under Section 528 of BNSS on the ground of availability of the alternative remedy to file a revision. Learned counsel for the applicant has not refuted the contention as raised by learned AGA. In this conspectus, as above, instant application under Section 528 of BNSS is dismissed, being not maintainable, on the ground of availability of alternative remedy, as mentioned above. Office is directed to return the certified copy of the order impugned to learned counsel for the applicant after retaining its photostat copy at the relevant place.
