Heard learned Counsel Mr. S.K.Goswami and Mr. R.Sarma, learned counsel for the applicants/appellants and Ms. S.Sarma, learned counsel appearing on behalf of Mr. D. Choudhury, learned counsel for respondents. 2. By filing this interlocutory application under Order 22 Rule 3 (2) of the Code of Civil Procedure, 1908, the applicants have prayed for, setting aside the abatement and for condoning delay of 562 days in filing the application for setting aside abatement of R.S.A. No.100/2014 so far as deceased appellant No.3, Ghanashyam Sarma is concerned. 3. I have considered the submissions at the Bar with circumspection. 4. I have also gone through the averments made in paragraph nos. 3 and 4 of the application which is quoted herein below: “3. That the applicants beg to state that the applicant/appellant No. 1 has taken all the steps in connection with the aforesaid case. The applicant/appellant No. 1 has engaged the present new set of advocates to conduct the aforesaid case in the month of September, 2018. Thereafter, the applicant/appellant No. 1 came to Guwahati on 17.03.2019 to discuss about the case with his new set of advocates and during the discussion, it has cane to the knowledge of the learned counsel that the appellant No. 3, Ghanashyam Sarma died on 05.04.2017. But the applicant No.1 could not inform the earlier sets of advocate about the death of appellant No.3, Ghanashyam Sarma and the earlier set of advocate of the applicants/appellants also not asked the applicant No.1 about the status of the parties. The applicant No. 1 is not aware about the necessity/procedure to file application for substitution of name of legal heirs in case of death of any of the parties in a civil case. Immediately, on 18.03.2019, the applicant No.1 handed over the particulars of the legal heirs and Page No.# 7/7 representatives of deceased appellant No.3 to his learned advocate. Accordingly, application for substitution along with the application for setting aside abatement and condonation of delay has filed on 19.03.2019. Therefore, there is delay of 562 days in filing the application for setting aside abetment of deceased appellant No. 3, Ghanashyam Sarma. 4. That the applicants beg to state that the applicants have ne knowledge about the requirement of law to file substitution application on the death of any of the appellant when the right to sue survives on the legal heirs Only, en 17.03.2019 during the discussion with the new set of advocate for the applicants about the present case, it has came to the knowledge of the applicants about the requirement of filing application for substitution of legal heirs and representatives on the death of appellant No.3, Ghanashyam Sarma, Immediately, the applicants has taken steps for filing the application for substitution of legal heirs and representative of deceased appellant No.3, Ghanashyam Sarma and accordingly, the application for substitution of legal heirs and representatives of deceased appellant No.3 has filed on 19.03.2019. The present appeal has abated so far deceased appellant No. 3 is concerned and there is a delay of 561 days in filing the application for setting aside abetment so far deceased appellant No.3 is concerned.” 5. Considering all the aspects, the prayer for setting aside the abatement and for condoning delay of 562 days in filing the application for setting aside abatement of R.S.A. No.100/2014 so far as deceased appellant No.3, Ghanashyam Sarma is concerned is hereby allowed. 6. In terms of the above observation, the interlocutory application stands disposed of.
