Respondents No. 5, 6, 7 and 9 are already ex parte vide order dated 29.04.2024. OMP No. 1245 of 2025 Heard counsel for the parties. Perused the application. The dispute inter se the parties was referred to a mediation. At the mediation, a settlement was arrived at on 4th January, 2025. Learned counsel for the parties jointly submit that in order to give effect to the settlement so arrived at inter se the parties, Sh. Lakshman Dass Kondal (Retd Tehsildar) R/o New Modern Colony, Opposite New Bus Stand, Palampur, Ward No.1 Nagar Nigam Palampur Pincode 176061 Mob No.9418008744 be appointed as Court Commissioner to give effect to the settlement on the spot. Intimation of this order be sent by the Registry and copy of the same may also be provided by the counsels appearing on behalf of the parties. Parties are directed to appear before the Court Commissioner on 24th September, 2025. Insofar as defendants No. 5 to 9 are concerned, they be associated in the process to be initiated in pursuance to the settlement arrived at inter se the parties. The Court Commissioner appointed shall locate, identify, demarcate and distribute/partition, the two parcels of land as detailed in the settlement arrived at inter se the parties on 4.1.2025. The Court Commissioner to submit his report on or before 14th November, 2025. List for consideration of the report of the Court Commissioner on 24.11.2025. Fee of the Commissioner so appointed is fixed at Rs.25,000/- to be shared by the parties. Besides the aforesaid, out of pocket expenses to be borne equally by all the parties.
