Several orders had been passed in this writ petition from time to time. On 16.07.2026, the following order was passed:- “Learned Senior Counsel for the respondent SJVNL informs the Court that the petitioner has been promoted to Executive E-8 Level during the pendency of the petition in compliance to the directions 1 Whether reporters of the local papers may be allowed to see the judgment? yes 2 passed by this Court. She further submits that the petitioner has approached SJVNL by way of a representation seeking promotion from a retrospective date. She further submits that as the matter is under the active consideration of SJVNL, the present petition be taken up for consideration after three weeks. Ordered accordingly. As prayed for, list on 11.08.2026.” 2. Learned Senior Counsel for respondent Nos. 1 & 3 to 5 has placed on record office instructions dated 31.08.2026 from the respondent-SJVNL. In terms of para-7 whereof, the claim of the petitioner can be considered positively for conferment of consequential benefits of promotion with effect from 01.10.2024 against one vacancy available at post of E9 level, consequent upon the superannuation of Shri H.K. Sharma on 30.09.2024, subject to the outcome of the disciplinary proceeding and withdrawal of the writ petition. The said clause reads as under: - “Consequent upon the superannuation of Sh. H. K. Sharma on 30.09.2024, one post at E9 level became available with effect from 01.10.2024. Accordingly, the claim of the petitioner can be considered positively for conferment of the consequential benefit of promotion with effect from 01.10.2024, against the available vacancy subject to outcome of the disciplinary proceedings and withdrawal of the petition.” 3. Learned counsel for the petitioner submits that petitioner is agreeable to the conditions imposed in the aforesaid clause of the office instructions in lieu of the consideration of his case for promotion 3 with effect from 01.10.2024 against the vacancy that became available on 30.09.2024. Learned Senior Counsel for the respondents submits that respondents shall take consequential action in terms of Clause-7, immediately on the conclusion of the disciplinary proceedings. In view of the assurance given by the respondents, learned counsel for the petitioner sought permission to withdraw the instant petition.
