CMP(M) No.308 of 2026 As per report of the Registry, notice issued to proposed LRs No.1(c) to 1(g) received back duly served, however, there is no representation on their behalf, hence, they are proceeded against ex-parte and it is presumed that they have got nothing to say in the matter. 2. The present application under Order 22, Rule 3 of Code of Civil Procedure (CPC) has been filed to bring on record the legal heirs of deceased appellant No.1- Rikhi Ram after setting aside the abatement, if any. 3. As per the applicants, appellant No.1-Rikhi Ram had expired on 26.11.2025 during pendency of the present appeal and he had executed a registered Will during his lifetime, thereby bequeathed his entire movable and immovable properties in favour of his sons, namely, Rajesh Kumar and Sushil Chandel, i.e. proposed appellants No.1(a) and 1(b), as mentioned in para-3 of the application, who are required to be brought on record. The application is duly supported with the affidavit of one of the proposed LRs, namely, Sushil Chandel as well as copy of death certificate of deceased appellant No.1-Rikhi Ram, Annexure A-1 and copy of registered Will, Annexure A-2. 4. No reply is intended to be filed to the application. 5. Heard. Keeping in view the facts and circumstances of the case, the present application is allowed and the legal heirs of deceased appellant No.1-Rikhi Ram, as mentioned in para-3 of the application, are ordered to be brought on record, after setting aside the abatement, if any. Amended memo of parties, annexed with the application, is ordered to be taken on record. 6. The application stands disposed of. RFA No.08 of 2024 7.
